Please read these Terms of Service carefully before using DateSim. By downloading or using the App, you agree to be bound by these terms. If you do not agree, do not use the App.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and DateSim ("Company", "we", "us", "our") governing your use of the DateSim mobile application and related services (collectively, the "Service").
By creating an account, downloading, or using the App in any way, you confirm that you are at least 17 years of age and legally capable of entering into a binding contract.
2. Description of Service
DateSim is an AI-powered dating confidence training application that allows users to:
- Practice conversations with AI avatars via voice and text.
- Receive real-time AI coaching and personalised feedback.
- Participate in structured missions, challenges, and daily streaks.
- Track progress through a DateSim Score and skill analytics dashboard.
- Complete the 30-Day Social Mastery program.
- Compete on leaderboards and earn XP to advance through rank tiers.
The Service is intended for personal, non-commercial use only. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice where possible.
3. Account Registration
To use DateSim you must create an account. You agree to:
- Provide accurate and complete information during registration.
- Keep your account credentials secure and confidential.
- Not share your account with any other person.
- Notify us immediately of any unauthorised use of your account at support@datesim.app.
You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts found to be in violation of these Terms.
4. Subscriptions & Billing
DateSim offers the following paid subscription tiers:
- Starter: $16.99 per month
- Pro: $19.99 per month
Subscriptions are billed on a recurring monthly basis. All billing is processed through the Apple App Store or Google Play Store, as applicable to your device. By subscribing, you authorise the relevant app store to charge the applicable fees to your payment method on file.
Free usage is available subject to the following limits: a maximum of 1 free practice session per day, and each session is capped at 15 minutes. Paid subscribers receive extended session limits and access to premium features.
5. Cancellation & Refunds
Cancellation: You may cancel your subscription at any time through your Apple App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the period expires.
Refunds: Refund requests are subject to the refund policies of Apple App Store or Google Play Store. We do not directly process refunds. To request a refund, please contact the relevant app store directly. Unused portions of subscription periods are not refunded by us.
No Commitment: There are no long-term contracts. You can cancel at any time.
6. Acceptable Use
You agree to use DateSim only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service in any way that violates applicable local, national, or international law.
- Attempt to gain unauthorised access to any portion of the Service or its infrastructure.
- Reverse engineer, decompile, or disassemble any part of the App.
- Use automated scripts, bots, or scrapers to interact with the Service.
- Submit false, misleading, or harmful content during any session.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Use the Service to harass, harm, or intimidate others in any way.
- Circumvent any subscription restrictions or access controls.
Violation of these rules may result in immediate suspension or termination of your account without refund.
7. AI-Generated Content & Accuracy
DateSim uses artificial intelligence to generate coaching feedback, avatar responses, and programme content. You acknowledge and agree that:
- AI-generated content is provided for entertainment and educational purposes and does not constitute professional psychological, therapeutic, or relationship counselling advice.
- AI responses may be imperfect, incomplete, or occasionally inaccurate. We make no warranties regarding the accuracy, reliability, or suitability of AI-generated content for any specific purpose.
- Statistics and results referenced in the App (e.g. "87% of users get a first date within 30 days") represent aggregate user-reported outcomes and individual results may vary significantly.
- You should exercise your own judgment when applying any advice or feedback received from the App.
8. Intellectual Property
All content, features, design, code, logos, and trademarks within the DateSim App are the intellectual property of DateSim or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes only.
You retain ownership of any personal data you provide, but you grant us a limited licence to use it solely to operate and improve the Service as described in our Privacy Policy.
You must not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any part of the Service without our express written permission.
9. Privacy
Your use of DateSim is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described therein.
10. Disclaimers
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any results obtained from the use of the Service will be accurate or reliable.
11. Limitation of Liability
To the fullest extent permitted by applicable law, DateSim, its directors, employees, partners, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from:
- Your access to or use of (or inability to access or use) the Service.
- Any conduct or content of any third party in connection with the Service.
- Unauthorised access, use, or alteration of your transmissions or content.
Our total liability to you for any claim arising from your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless DateSim and its affiliates, officers, agents, and employees from any claim, damage, loss, liability, and expense (including legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
13. Governing Law & Disputes
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising in connection with these Terms or the Service shall be resolved through good-faith negotiation. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration in accordance with applicable rules, unless you opt out or your jurisdiction requires otherwise.
14. Modifications to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will provide notice via the App or by email. The "Last updated" date at the top of this page reflects the most recent revision. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
15. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, including but not limited to if you breach these Terms. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, and limitations of liability.
